The Islamabad High Court (IHC) has delayed the appointment of Pakistan Telecommunication Authority (PTA) Member (Administration) and ordered the federation to stop recruiting under the impugned advertisement until the next hearing.
The IHC acknowledged Writ Petition No.1561 of 2023 by Usama Khilji Versus Federation of Pakistan, etc., where Asad Ladha represented the petitioner.
High Court stated that the petitioner is aggrieved by the PTA advertisement for Member (Administration).
The petitioner claimed that Section 3 of the Pakistan Telecommunication (Reorganisation) Act, 1996 (“Act”) created three PTA member roles. Only the federal government can add employment.
He argued that Cabinet has not yet created a post for member admin, hence the announcement of induction violates the Pakistan Telecom Authority’s Chairman and Member (Appointment and Qualifications) Rules, 2013 (“Rules”).
Petitioner claimed the notification violated the Act and Rules.
After hearing the plea, the court ordered the respondents to stop recruiting under the impugned advertisement until the next hearing.
